Running late as usual. At least they aren’t using whiteboard markers. Since it’s Friday and we’ve got nothing better to do, we’ll be live-blogging below.


4:02: Starting in two minutes? You’re already 12 late Mr President. We realize you’re the President but some of us have holiday cheer to spread, get with it.

4:05: Filing in. Finally. Biden in the Hizzous. Cracks about a “big deal,” without the F-bomb, this time. Shout out to half-man, half-tortoise, Mitch McConnell. Bipartisanship lives!

4:08: The big guy is up. Applause. Biden is semi-beaming. BHO gives a shout out to the Veep. Biden grins like only Biden can. Love for McConnell and Dave Camp. Shot of Larry Summers is less than flattering. Did his mother teach him anything about sitting up straight? Yeesh. Bipartisanship, bipartisanship, bipartisanship. We get it. You managed to play nice, what do you want, reelection?

4:13: Al Sharpton? Golf clapping? Can someone explain why the Rev is at this thing?

More name-dropping. Nancy, T Geith, Boehner. Sigh.

Who’s Going ‘Above and Beyond’ at McGladrey?

A few people, apparently.

The “prestigious 2010 McGladrey Achievement Awards” are only given once a year (we think) and while C.E. Andrews realizes everyone is doing their part, there are a few people that need special recognition, “While all of our employees are focused on the client, these award winners are being recognized as having gone ‘above and beyond’ to ensure client success.”

But enough with the boilerplate, on to the names:

This year’s winners include:

• Dalia Pearson (Ft. Lauderdale) was recognized as Employee of the Year for her can-do attitude and excellent customer service
• Michael Sher (Chicago) was recognized as Partner/Managing Director of the Year for his strong work ethic, industry expertise and his industry knowledge.
• Jennifer Murtha (Melbourne) was recognized as Career Advisor of the Year for developing talent, cultivating teams and relationships and helping to shape the firm’s future.

Individual and team awards were also presented for relationships, excellence, integrity and unity. Team awards included the Great Lakes Core Tax Team, Ohio Private Equity Growth Team, Building Trust Through Service Engagement Team, the Olympus Capital Audit Team and others.

Obviously this is stupendous news but what we’re curious about now is, what does extra-special people receive for such a prestigious honor? A year’s worth of bragging rights is a given but is there any money involved? As much punch and cake as their hearts desire? A lunch with your Mickey G’s-sponsored golfer of choice? We need answers. Or wild-ass guesses.

Marin County Adds ‘Racketeering’ to the List of Allegations Against Deloitte

Hell hath no fury like an obscure California county that feels completely gypped (to the point that they feel it’s fraudulent) by the largest professional services on Earth.

Marin officials fired another salvo in an escalating $105 million legal war with international computer consultants, filing a new lawsuit Thursday accusing them and a former county official of violating racketeering law in a bid to rip off taxpayers.

The new suit was filed against Deloitte Consultant LLP, software developer SAP and former assistant auditor-controller Ernest Culver, who served as project director of the county’s troubled computer installation before quitting to join SAP.

As you may recall, Marin County’s original suit against Deloitte for $35 million involved allegations of “fraud, misconduct and misrepresentation” which included using ‘neophytes’ on the implementation of the county’s ERP system. The new racketeering charges are especially interesting and the Marin Independent Journal has the details:

It alleges a conspiracy, asserting consultants wined and dined Culver and interviewed him for employment at the same time Culver was approving deficient work on the project, approving fee payments and helping line up new contracts.

“County taxpayers were charged for millions of dollars in services that Deloitte failed to properly perform” and residents were “defrauded of the honest services of a high-ranking county official,” according to County Counsel Patrick Faulkner.

Deloitte denied the allegations of the original suit, saying that Marin County was actually responsible for the snafu. However, and unfortunately for Deloitte, new shit has come to light:

Faulkner disclosed that the county has combed through its computer system to retrieve thousands of e-mails issued by consultants and Culver while they worked in county offices, providing a backbone for accusations leveled by the latest suit.

The complaint alleges six violations of the federal Racketeering Influenced and Corrupt Organizations Act by Deloitte and SAP, and three counts of illegal conduct against Culver, including a violation of the state anti-corruption statute.

So it doesn’t sound like there’s a smoking gun per se but enough back and forth that adds up to this:

The lawsuit, the county said in a press release issued late Thursday, claims that when problems with Deloitte’s work surfaced, Deloitte and SAP engaged in a “cover-up that included bribing Culver to falsely ‘approve’ Deloitte’s defective work, and silencing an SAP employee who tried to intervene on the county’s behalf.”

So, in other words, pretty bad stuff. The MIJ reports that “Settlement talks are expected and while the parties remain at odds, the latest court filing could spur negotiations.” Using our best translation skills, this more or less says, “Deloitte, SAP and Culver realize they’re fucked – begrudgingly – and will be going to the table any day now to sort things out.”

The Independent Journal also reports that SAP, Deloitte or Ernest Culver “could not immediately be reached.” Our own messages with Deloitte spokemen Jonathan Gandal and John La Place were also not immediately returned.

I’m a recent new hire at a big 4 firm in LA, and I’ve been working for the firm since October. I’m hating the job and already want to quit. I’m currently looking for jobs as we speak. Is it inappropriate to quit during busy season? How do I do so in a “polite” way?

Dear HatingMyJob,

Your dilemma is not uncommon but we are curious as why you would accept a job that, at least semi-consciously, you already hated before you started. You essentially took a job from someone else that probably would sacrifice an appendage for the opportunity you have.

Now that we have sufficiently guilt-tripped you, we’ll address your problem. Way back in February, we addressed this very issue and here are a few thoughts we had then:

All the people we’ve had the pleasure of working with, despite all of them having multiple “F— THIS!” moments, pull it together because they have a job to do. Why the hell didn’t you quit prior to busy season? You really felt like sticking it to everyone?

Fine. Perhaps your desire for sweet, sweet revenge against your senior/manager/partner/firm is more powerful than any shred of integrity you may have but for crissakes, that makes you a very bitter person. More so than the average accountant.

We’re not sure what has happened in the last 10-ish months but we’ve mellowed on this position. That being said, we’re putting you on notice, regardless of whether you quit now (pre-busy season) or in mid-February, people will be JUDGING YOUR ASS. We’re not talking Chief Justice judging, we’re talking the WRATH OF THE ALMIGHTY judging (if your an atheist, think of it this way – science will get medieval on you with Lou Gehrig’s or something else sufficiently terrible). Hopefully you’re okay with that because your ears will be burning.

Accordingly, there’s no reason for you to worry about being polite about it. In fact, you’re better off admitting that you hate the job (feel free to get specific) and it isn’t for you. That involves you admitting that you made a mistake but hey, we all make them. It may save you a little face with some of your colleagues.

The good news is, your recruiter – if you’re using one – is going to be able to help you more during busy season because they won’t have a backlog of people burning up their phones with, “For the love of GOD, get me out of this job!” If you’re not using a recruiter, we suggest you find one and level with them about your situation. You’re not desperate but you want out ASAP. The process takes a little bit of time and you’ll be ahead of the people that choose to battle out busy season.

So, if you’re fed up. Fine. Nothing you can do to change that. If you’re looking, that’s good; you’ll have a leg up on the new associates that decide to leave after busy season. Good luck.

Five Ways To Stick To Your CPA Exam Plan During the Holidays

If you’re like most of us, you’ve been half checked out since Thanksgiving [Ed. note: like you don’t even know] and are most likely spending your December gorging yourself on cookies and getting tipsy at holiday parties. But if you’re also studying for the CPA exam, it’s critical to stick to your schedule or else you’ll end up in February wondering why you haven’t studying at all for the exam you scheduled months ago. Here are five quick and dirty ways to stick to your plan.


Turn people down Yes, we know it sucks to have to say “no” but the big key to getting through the exam is being disciplined, which sometimes means saying you’ve got to stay home and study when friends and family are begging you to come out and play. Keep your commitments to a minimum and only do the holiday activities you’ve absolutely have to without being disowned by your family. If you must attend a wild company party, make sure you don’t turn a day of partying into a week of recovering.

Take your CPA review materials with you If you’re traveling out of state to see family, it’s important to bring your review materials with you so you can keep studying while you’re sitting around hearing about your Uncle John’s aches and pains and/or third wife. Bonus: studying is a great excuse to get out of awkward family interactions and shoveling snow so break out the books and show them just how disciplined and determined you are. We guarantee it will inspire oohs and ahhs at the table and hopefully keep you on track to pass next window.

Stick to your schedule If you’ve taken our advice so far (we swear we’re qualified to dispense said advice), you already have a rock-solid study schedule that accounts for every hour of every day and has studying penciled in between work and sleep whenever you can sneak it. Don’t allow the holidays to invalidate that schedule, simply reschedule some areas accordingly. If you blow off entire chunks of your schedule to sip cider and make gingerbread houses with the nieces and nephews, you’re that much more likely to keep blowing it off come January. Adjust your schedule if you have to but be sure to stick to it!

Turn your social aversion into a study tool If you’re like most people – especially accountants – you can’t stand awkward social interactions. Since you’re studying for a professional examination with a reputation for being all-consuming, you’ve got an out when it comes to lame social activities like tree-trimming, caroling, and/or volunteering down at the homeless shelter. Screw all that, leverage your CPA exam misery to your benefit and use it as an out. It’s either that or recruit the homeless guys to help you blast through flashcard drills while you’re handing out Christmas Day turkey at the shelter.

Use days off to study… MORE! Yes I said it. You might have half days or PTO to cash in or the post holiday-party day after to lay around at home and recover but instead of taking a holiday, try squeezing in a little more study time so you’re that much more ready come next year.

And lastly, though this isn’t exactly a tip, ENJOY YOURSELF. You’ve earned a nice little break so take advantage of it, just don’t blow your entire plan in the process!

So, House of Klynveld pre-managers, what’s the consensus? It’s an extra bonus, paid twice, all practices are eligible and the firm will “continue to monitor the marketplace” (translation: read Going Concern) to make sure things stay competitive. It seems like a decent deal, although the award amounts are TBD. The only problem that we foresee is the time-honored tradition of some people putting in face time merely to run up their hours. Granted, budgets should help self-regulate that phenomenon but we all know how well that works.

Could KPMG’s Improved Revenue Mean More Omaha Steaks for Employees?

Yes, that’s a question for the group. But first, we should mention that despite the glaring lack of exclamation points, you can’t help but think that T Fly is running around 345 Park (or wherever he puts his feet up these days – is he in A/dam?) high-fiving everyone that crosses his path about the slight uptick in this year’s results:

Area Man Under the Assumption That Firing an IRS Examiner Was Within His Powers as an American Citizen

Mining obscure tax court cases for blog posts during this slow time of year, Joe Kristan discovered this little gem:

In the April 4, 2008, letter petitioner stated that respondent [IRS] had repeatedly refused to answer his questions regarding Code sections that define income and property received as income and establish respondent’s “Delegated Constitutional and Legislated Lawful authority”. The letter contained meaningless language, for example: “I do hereby give you notice that you, and all you are, are Fired from any and all representation of my private affairs without recourse“.

Making Work Pay Tax Credit May Make Taxpayers Pay

News from our favorite federal taxation authority this morning reveals that while the IRS believes they did everything they were supposed to, some taxpayers may have taken their Making Work Pay credits incorrectly, causing them to actually owe money instead of celebrating free money. Oops! The Treasury Inspector General did their best to warn everyone this could happen and, oh look, it did.

Overall, the Internal Revenue Service (IRS) implemented the Making Work Pay Credit as intended by Congress, according to a report publicly released today by the Treasury Inspector General for Tax Administration (TIGTA).

However, the report also found that approximately 13.4 million taxpayers who received the credit may owe taxes because adjustments to the withholding tables did not take into consideration all taxpayer circumstances. For example, single taxpayers with more than one job, joint filers where both spouses work or one or both of them have more than one job, taxpayers who receive pension payments, and Social Security recipients who receive wages are among those who may be negatively affected.

The Making Work Pay credit is an economic stimulus provision of the American Recovery and Reinvestment Act of 2009 (Recovery Act). The credit is advanced to taxpayers by their employers through withholding reductions which results in an increase in taxpayers’ take home pay. The credit is effective for Tax Years 2009 and 2010.

“The Making Work Pay Credit is a key tax credit designed to increase spending and stimulate the economy,” said J. Russell George, the Treasury Inspector General for Tax Administration. “However, many taxpayers who are accustomed to receiving refunds when they file their tax returns may have owed taxes and incurred penalties in 2009 and may yet again in 2010 because they were advanced more of the credit than they were entitled to claim,” Mr. George added. “My office issued a report in November 2009 warning of this possibility and encouraging the IRS to increase outreach and waive penalties for taxpayers who may be negatively affected by the credit. We still believe further actions are needed to ensure no taxpayer is unfairly penalized.”

The November 2009 report warning this could go down mentions that some taxpayers were proactive and adjusted their withholding so as not to be impacted by the potential “free money” presented by this “credit” which, for some taxpayers, will turn into money owed back to the Treasury or even tax penalties.

The credit was advanced to taxpayers by their employers through withholding reductions that result in an increase in take home pay, in the hopes that $400 ($800 for joint filers) more in each eligible taxpayer pocket might help increase spending and stimulate the economy. Because of the nature of the credit, however, some taxpayers may have had their taxes underwithheld at the end of the year.

Big 4 Shoots Blanks on Glassdoor 50 Best Places to Work

The following was brought to our attention this morning:

Glassdoor just published their 50 best places to work… and I believe none of the Big 4 are on it. Surprise surprise?


So we checked it out and yes, it’s true that none of the Big 4 (or any accounting firm for that matter) appear on the Glassdoor 50 Employees’ Choice Awards for 2011.

It’s worth noting however, that the methodology for this particular list is driven entirely by audience participation. From the FAQs:

The Glassdoor list is the only list that truly represents employees’ choice. Unlike many workplace-related awards that require companies to self nominate, Glassdoor relies solely on the input from employees. All that is required for consideration is an employer must have had at least 25 employees complete a survey to be considered.

So you could probably conclude one of a two things: a) Fewer than 25 employees of each firm bothered to visit Glassdoor to sing their firm’s praises or b) the reviews were so incredibly negative that the firms landed nowhere near the Top 50.

Now, possibility “a” seems unlikely since there are plenty of people working at these firms that don’t have anything better to do than mindlessly surf the web and participate in seemingly innocuous surveys and whatnot. Possibility “b” seems a little more realistic, so we’ll explain our thinking:

Since this particular list doesn’t have an application process, it is merely up to some ambitious person in the marketing/Internet reputation department to take the initiative to spread the word about this campaign TO EVERYONE IN THEIR OFFICE. Besides the fact that asking employees to add one more thing to their already-impossible-to-conquer “to-do list,” these types of emails are largely met with eyerolls that would cause most people to topple over backwards in their chairs. But rather than simply delete the message, this wells up so much annoyed rage within the bitter Big 4 Bobs/Betsys out there that they immediately proceed to the survey to crucify their firm out of spite.

Or then again, maybe we’re just cynical. If you’ve got your own theory, do share.

Someone in the Frazer Frost Marketing Department Didn’t Get the Memo RE: No Mas Frazer Frost

Last month we told you about the break up of Frazer Frost, a firm that was born out of the combination of Moore Stephens Wurth Frazer Torbet, LLP and Frost, PLLC. Turns out, the announcement made in November 2009 left out the part that it was just a ‘trial merger’ and after a year, they scrapped it for various reasons that included a) a ‘culture clash’ b) ‘issues in the Chinese reverse mortgage practice’ and c) well, those first two are pretty bad.

While it’s unfortunate when these things don’t work out, it would be assumed that everyone working at the firm would be acutely aware of the situation. A merger doesn’t exactly qualify as a “minor administrative issue” that gets overlooked. Nevertheless, a tipster sent us the following picture that appeared on page 48 of the December issue of Celebrate Arkansas.


Judging by this ad, you might get the impression that Frazer Frost was in fact still a firm and if one visits www.frazerfrost.com that’s when it gets hella-confusing:

Moore Stephens Wurth Frazer Torbet, LLP and Frost, PLLC are moving to resume operations as separate entities, as existed prior to their combination in January 2010. The combined firm, Frazer Frost, LLP, will continue to exist as a legal entity until the separation has been completed. It continues to be the policy of both firms not to comment publicly on client, personnel, or other internal matters.

Maybe we’re a little slow but if the two firms are “moving to resume operations as separate entities” but “The combined firm, Frazer Frost, LLP, will continue to exist as a legal entity until the separation has been completed,” we interpret that as “Frazer Frost is still technically a firm but in reality, it’s only a matter of time until we’re not.” It’s seems like a bad breakup where two people continue living together in a tense, awkward environment where way uglier shit gets said than during the actual break-up but they’re both stuck in this god-awful situation until somebody finds a new apartment.

Regardless, placing an ad in a periodical could be construed as misleading but that’s just us. If someone at the firm can explain it to us, we’ll be here. While we wait, if you’ve got thoughts on whether this ad is perfectly hunky dory or a little dubious, share below.
